Terms of service.

1. Purpose

These terms of service (the "Terms") govern access to and use of the MiamScan platform (the "Service"), operated by MiamScan, headquartered in Tunis, Tunisia. Any person accessing the Service unconditionally accepts these Terms.

2. Definitions

• Restaurant: any establishment (café, bakery, restaurant, tea room, etc.) subscribing to use the Service.
• Customer: end user who downloads the MiamScan mobile app and earns rewards at a Restaurant.
• Account: personal space opened on the Service by the Restaurant or the Customer.

3. Account creation

Opening a Restaurant Account requires accurate information (company name, address, contact). The Restaurant warrants the truthfulness of the information provided and undertakes to keep it up to date. Creating a Customer Account is free and open to anyone of legal age.

4. Subscription and billing

The Service is offered to Restaurants as a monthly subscription (Basic, Premium, Pro, Enterprise) billed in Tunisian dinars (TND). Subscriptions are without commitment and can be cancelled at any time from the dashboard. A 14-day free trial is offered on first sign-up, with no payment method required.

Any month started is due. After cancellation, access to the Service remains active until the end of the paid period. Restaurant data is retained for 90 days after cancellation, then permanently deleted.

5. Intellectual property

All elements of the Service (interface, code, marks, logos, copy) are the exclusive property of MiamScan or are licensed to it. Any reproduction, representation or exploitation, in whole or in part, without prior written authorisation, is forbidden.

Content created by the Restaurant (loyalty cards, promotions, customer file) remains the Restaurant's property. MiamScan only holds the hosting and processing licence needed to operate the Service.

6. Data and security

Processing of personal data is covered by our privacy policy. MiamScan implements reasonable technical and organisational measures to ensure data security: at-rest encryption, daily backups, optional strong authentication.

7. Liability

MiamScan undertakes to deliver the Service with a 99% availability target, excluding scheduled maintenance. MiamScan cannot be held liable for losses of revenue, customers or data caused by the Restaurant's fault, force majeure or a third party.

The Restaurant is solely responsible for content published via the Service (promotions, descriptions, push communications) and warrants compliance with applicable Tunisian law.

8. Changes to the Terms

MiamScan may change these Terms at any time. Users are notified by email at least 30 days before the new terms take effect. Continued use of the Service constitutes acceptance.

9. Governing law and jurisdiction

These Terms are governed by Tunisian law. Any dispute regarding their interpretation or performance falls within the exclusive jurisdiction of the Tunis courts, unless mandatory provisions provide otherwise.
